As HONG MIAO Garment Co; Ltd which locates on No.4 Road, Thar Du Kan Industrial Zone, Shwe Pyi Thar has committed the highest violation of labor rights and then closed the factory, the labours waited 7 nights in the factory, but they had to go home without any settlement.
“They asked for 7 nights and 8 days, but didn't get an agreement. The labours took back the chairs they were sitting on. As water got into the factory and they got sick because of the paper got wet. We had an adjustment this morning. After almost 3 hours of adjustment, we didn't get any agreement. The labours had to go home with only what they paid," said a source close to the labours.
As HONG MIAO Garment Factory said that they will pay September's wages on October 5th due to the factory closing, the labours spent 7 nights and 8 days in the factory to request for certain points such as to compensate those who have less than 6 months of experience, to pay compensation to pregnant labours as they don’t have social security allowance, and to pay the same as before for the tap servicers and to get their wages immediately.
He also said that the factory opened a case of theft against the two labours who were waiting overnight for negotiations but the case was dropped and released later.
The labours also said that although officials from the Township Labor Departments as well as administrative organizations such as general administrations were involved in negotiating the demands, instead of paying the 1 month notice fee, damages specified in the labours’ rights law with the last salary without OT, the supervisor of Office of Labor Guidance told to pay the notice fee with only the basic salary with the favor of the employer.
Before the closure of the factory, the labours applied to the Labor Office to form a labor union, but there was no inspection and no form was given too. The employer found out the list of unionized labours from the head office, and fired 48 union members by the reason that they did not have orders.
In addition to the union-busting dismissals, the labours said that they will continue to file complaints to the brands and ILO due to rights violations, and will request the rest of the money by linking to international organizations.
