The Junta’s Ministry of Labour has announced that W&F garment factory which violated 4 sections would be filed lawsuit, but the factory is known called the overtime again from the labours.

“The factory started to called the overtime again since the 4 days after the new moon day. It has been a week. The overtime is until 18:30 and the days that reach 21:00 exists among them.”, said by a factory labour to Myanmar Labour News.

W&F Group Co., Ltd violated more than 10 issues including called overtime for more than 3 months. The Ministry of Labour filed lawsuit the factory after Myanmar Labour News expressed more than 3 times about the cases in articles and news.

The Ministry announced that W&F Group Co., Ltd broke the 1951 Section 59 of the Workshops Act; 59, 63, 64, 71 and will be prosecuted under Section 85.

Under the prosecution section, a fine of more than 20 lakhs MMK including 3 months imprisonment can be imposed.

The latest inspection was on July 7, announced to take action was on July 28, called overtime again is on August 4 so that it is not cleared that if the case is completed within a week or they called overtime again without case completion. As per my knowledges, it would take a week or two and forbit to called overtime within that period. Is the factory called overtime again without completion. It is clear that the factory is continue to violate the rights and bribery exists too.”, said by Ko Myo Thein, a laboural activist.

The Workshop Act stipulates that if the violation continues, a penalty of not more than 100,000 MMK can be imposed for each day of the violation.

The workers said that the ministry has taken action against the factory, but they no longer have confidence in the complaints and labor offices because they continue to call for overtime.

“They can’t with stand physically or mentally anymore for being called overtime more than 3 months. The factory is inspected only because of the reports by those who can effort. Even so the military came to inspect in the last overtime. No officers from Township laboural office presented there. The overtime stooped back then and it happens to be going to file lawsuit. Labours and stuffs resign because of this. They called again now. We know that we can report but we don’t believe on the actions anymore.”, said by a W&F group labour.

W & F Group Co., Ltd has continued to take overtime and pay unethical wages, according to the workers who quit their jobs.

"In June, 5,600 wages were paid. I quit my job in July. When the salary was issued in August, it was only 4,800. Does this company have a reputation? We want the employers to know that our workers also choose the reputation of the factory," she said.

The garment factory of W & F Group Co., Ltd is owned by a Chinese national, according to a statement from the SAC Ministry of Labor.

The factory resides in No. 253, Thain Chaung Road, Watayar Industrial Zone, Shwe Pyi Thar Township, Yangon Region and operates with a workforce of around 800 according to information from Myanmar Labor News.
