The lawsuit against the Pepsi CEO and HR manager will be heard next month

According to the Federation of Solidarity Unions (STUM), which is supporting the issue, a hearing has been scheduled for October 6 regarding the lawsuit filed by the labour against the officials of the Pepsi soft drink factory in Mawbe Township.

Last August 14th, at 10:00 a.m. in the morning of the division court, there was a trial negotiation but no settlement was reached, so a further hearing was scheduled for September 14th at the Mawbe District Court.

"At today's trial, the documents do not arrive back to the district court, so the 6th trial was scheduled for October 6th. One month after the division trial (14-8-2023), the process has not yet arrived at the lower office, so it's the next appointment," STUM informed. 

On July 28th, as the third trial of the worker's lawsuit, the district judge accepted both sides of the employer and labour and interrogated them. The entrepreneur delegated the legal representative to HR on behalf of the CEO and HR, and the two parties negotiated in the district court according to the legal negotiation procedure.

U Thaung Han, the aggrieved labour who filed the lawsuit, was fired on October 31, 2022 due to his old age in violation of the employment agreement, so he sued for 10,040,000 MMK in legal damages in the Mawbe District Court.

On November 2022, U Thaung Han, who was fired, filed a complaint to Department of Labour Guidance and transferred it to the township negotiation, which negotiated 3 times. Although the council's decision was accepted, it was transferred back to Department of Labour Guidance, so Department of Labor Guidance and the regional office negotiated three more times to resolve the issue, but there was no solution. It is reported that the labour was instructed to file a lawsuit only in the middle of March 2023, only after the victim worker repeatedly requested the supervisor to issue an order to file a lawsuit against the victim.

If the fired labour who worked for up to twenty years is fired because of his age he must get the severance of 4,050,000. It is reported that this kind of lawsuit started because the labour issued a letter of intent to file a lawsuit after a long time of the employer's agreement on the negotiation.

The labour who worked at the Pepsi factory for 20 years and was fired on 31 October 2022 in violation of the employment contract. According to seniority laws, he will receive severance pay of over 50,000 kyats.
