It is reported that the judge has ordered that not only the CEO and HR of the factory, but also the Company should be sued in the lawsuit filed by the workers against the officials of the Pepsi soft drink factory in Mawbe Township.
“Although only the CEO and HR were originally sued, the judge ordered to add the name of Pepsi Company at today’s trial,” said Solidarity of Trade Unions, Myanmar (STUM), an organization helping with the case.
The case filed by former employee U Thaung Han (Pepsi) was conducted by the judge that the company to be sued too after both sides were examined at the Mawbe District court during the trial on April 3rd and the next trial was scheduled at 11:00 PM on April 25th.
U Thaung Han, the aggrieved worker who filed the lawsuit, was dismissed on October 31, 2022 due to his age, which is against the employment agreement, so he sued for 10,040,000 kyats in legal damages in the Mawbe District Court.
U Thaung Han reported to department of labor at Novembet 2022 and the case was handed to township mediation which they negotiated for three times and after that re-handed to department of labor although they accept the decision of the aarbitration. The department of labor and division office collaborated to negotiate for three times but resolvents were not reach and it was only in the middle of March 2023 that the worker was instructed to file a lawsuit because the victim worker had repeatedly requested the supervisor to issue an order to file a lawsuit.
Since the worker had worked for twenty years, if he were to be dismissed on the grounds of old age, he would have to receive damages of 5,040,000 kyats and they negotiated with 40 lakhs but the employer had denied and the worker started to sue far later only when the instruction to sue was ordered by the court.
The worker had worked at Pepsi Soft drink factory for 20 years and dismissed on 31st October 2022 against the employment contract and he is entitled to more than 50 lakhs of damages according to his seniority.
