Sky Fashion Myanmar Garment Factory Forces Workers With Nearly One Year of Service to Switch to Daily Wage Status Over Age Claims

Workers at Sky Fashion Myanmar garment factory say employees with nearly one year of service have been forced to change their employment status to daily wage workers after the factory claimed they were underage. Workers said age verification was conducted when they were first hired, but after more than eight months of service they were required to switch to daily wage status.

“They checked whether we were of legal working age when we were hired. Now they say we are underage and change us to daily wage workers, which harms the workers. They told us that and if not we should resign if we can accept the change we should continue working,” workers said.

Workers said that although current labour laws do not distinguish between the rights of daily wage workers and permanent workers, in practice daily wage workers in factories are often unable to contribute to social security and do not receive leave entitlements. They also said other workers in the factory are unable to fully enjoy the rights guaranteed under labour law.

“They do not grant casual leave or medical leave. If we are absent without permission, they deduct the daily wage and attendance bonus. Even when we are sick, they do not grant gate passes. At the same time they demand that production targets be met. When we work overnight and late-night overtime, the factory sends workers home in trucks in the morning, but since there are many workers, the last group arrives home around 8 a.m.,” workers said.

Workers also said they are sometimes required to work overtime in the morning. Production targets have been increased to levels that workers struggle to meet, forcing them to sew continuously without going to the toilet or drinking water in order to reach the target.

“The line manager is even worse than the line supervisors and supervisors while we are already sewing under pressure. He is very rude. He has even threatened that when he arrives no one should look up at him,” workers said.

Workers also said that although there is a Workplace Coordination Committee (WCC) in the factory, its members are factory supervisors appointed by management rather than representatives chosen by workers. As a result, workers say the WCC does not help resolve workplace problems.

Sky Fashion Myanmar Co., Ltd garment factory is located on Mya Sabei 1 Street, Mya Sein Yaung Industrial Zone, Yangon. The factory is owned by Chinese citizen and employs more than 800 workers, producing garments for the Alvaro Moreno brand.
