HONG MIAO Garment Co; Ltd which locates at the No (4) Road, Thar Dhu Kan Industrial Zone, Shwe Pyi Thar Township, Yangon closed the factory after committing the highest level of labour rights violations, according to those helping the labours.
"The guards were called to the Huan Myung factory. The owner did not come and said the factory would be closed. The boss did not come but sent the HR. Then they called the guards and threatened to sign and then close the work. The labours are not signing but they are planning to pressure and threaten the labours," said a labour.
"Hua Myung Factory closed the factory on the grounds that there were no orders on September 26 and sent notice to the workers. The factory has been open for more than a year. This is a factory that the ministry found out because of a series of violations of labor rights in a warehouse where they operated illegally in Thar Dhu Kan industrial zone. Although they conducted inspections in the factory, none of the demands of the workers were implemented because the employers were hand in glove with the inspectors. On September 6, they gave me the forms to register the organization, but the head of the Office of Labour Guidance did not issue Form 6 but ignore. In addition, they are failing to take action to meet the minimum wage. Would the factory really close? Would they cheat and open it again? Whether they want to abolish the formation of the union will have to continue to be monitored,” said an individual helping the labours.
As there are many violations in the factory, the labours applied to the head office to form a union, but they did not come and inspect it, nor give the Form 6. The employer found out the list of 48 labours who formed a union from the head office of labor, and fired those on the grounds that they did not have an order.
The 9 labours who were fired prior are also union members. This list of the labours was given to the entrepreneur by the head of the Office of Labour Guidance, and the entrepreneur fired according to this list. Line 2 was not paying by saying that there are no orders. Line 2 labours were sent to lines 3 and 4 but the rewards from those lines were not given to labours who were moved from Line 2. If they send the labours to Line 3 go, they have to pay them the same as the other labours of the line, and those labours sent a message that they can't pay less than one hundred thousand. There are many violations. Essentially, dropping all 48 members from 1 to 48 in the union is the most serious violation,” said the supporter.
On September 20, negotiations were held, and the fired labours returned to the workplace and said they would continue to negotiate with other violations, but the 9 union leaders were not reappointed.
The HONG MIAO Garment Co; Ltd factory is a factory that manufacture FieldCore brands. After settling the dispute on September 21st, the labours working in the factory are working in a dangerous workplace due to water entering the workplace, said by the supporter.
The water used in the factory is not clean and clear, they are using dirty water and there is no fan installed in the workplace, so the workers made demands. On September 26th, with the reasons of saying that there was no order, and they took out a notice to close the factory, said by the people who are helping with the labour issues.
