Hearing begins for worker's lawsuit against Pepsi soft drink factory CEO and HR manager

On November 14, a two-sided interrogation was conducted regarding the lawsuit filed by the worker against the officials of the Pepsi soft drink factory in Mawbe Township according to the Solidarity of Trade Unions Myanmar (STUM), which is supporting the worker’s affair.

"There are objection, defense and orders from both sides of the lawsuit filed against the employer and HR. This is according to civil law case of the law, the question was asked, and the judge made an order weather accept or reject or he also objected. So, the judge has to decree at the next trial," said the person assisting the worker.

The November 15th trial was the 10th trial and the upcoming 11th trial was also rescheduled to the next month, and to decree to the defendant ‘s objection letter on that day.

On July 28th, the employee's lawsuit was heard as the third trial, and the district judge accepted and interrogated the 2 sides of the employer and employee. The entrepreneur delegated an official representative to HR on behalf of the CEO and HR, and the two parties negotiated in the division court according to the legal negotiation procedure.

U Thaung Han, the aggrieved worker who filed the lawsuit, was fired on October 31, 2022 due to his old age in violation of the employment agreement, so he sued for 10,040,000 kyats in legal damages in the Mawbe District Court.

On November 2022, U Thaung Han, who was fired, complained to Labor Guidance office and transferred to the T township coordination group. They negotiated 3 times there and accepted the decision of the council, but it was transferred back to Labor Guidance. Labor Guidance and the Division office collaborated and negotiate three more times to resolve the issue, but there was no resolution, and as the victim worker repeatedly requested the supervisor to issue an order to sue the victim, it was only in mid-March 2023 that the worker was instructed to file a lawsuit.

The worker worked at the Pepsi factory for 20 years and was fired on the 31st day of the 10th month of 2022 in violation of the employment agreement. It is also known that he will receive severance pay of over 5,000,000 kyats according to the seniority.
